Terms and Conditions

Welcome to Popshot, a mobile application developed and operated by VAR TIM SOFTWARE SRL (“Company”, “we”, “our”, or “us”), registered in Timisoara, Romania.
These Terms and Conditions (“Terms”) govern your access to and use of the Popshot iOS application (“App”).
By downloading, accessing, or using Popshot, you agree to be bound by these Terms.
If you do not agree, do not use the App.

1. Eligibility

Popshot is intended for individuals aged 13 years and older.
By using the App, you confirm that you are at least 13 years old (or the minimum legal age in your country) and have the legal capacity to enter into this agreement.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use Popshot for personal, non-commercial purposes in accordance with these Terms.

You agree not to:

Copy, modify, or distribute the App or its content;
Reverse engineer, decompile, or attempt to extract the source code;
Circumvent or interfere with the App’s security or usage restrictions;
Use the App for any unlawful, harmful, or abusive purpose.

All rights not expressly granted to you remain reserved by VAR TIM SOFTWARE SRL.

3. User Content

a. Ownership

You retain all rights to the photos and images you upload or edit within Popshot (“User Content”).

b. License to Process

By uploading or editing content, you grant us a limited, worldwide, non-exclusive license to temporarily process, store, and modify your content only for the purpose of providing AI editing and remixing services within the App.
We do not claim ownership of your photos or use them for any other purpose.

c. Storage and Deletion

Uploaded content may be stored temporarily on our secure servers during AI processing and is automatically deleted within 90 days of subscription expiry, or sooner if required by law.

4. In-App Purchases and Subscriptions

a. Payment Processing

Popshot offers paid features and subscriptions through Apple’s App Store In-App Purchase system, managed via RevenueCat.
All billing and refund requests are subject to Apple’s App Store Terms and Conditions.

b. Subscription Management

You can manage or cancel subscriptions at any time through your Apple ID settings.
Deleting the App does not automatically cancel your subscription.

c. Auto-Renewal

Unless cancelled at least 24 hours before the renewal date, subscriptions will automatically renew at the end of each billing period.

5. Data and Privacy

Your use of Popshot is also governed by our Privacy Policy, which describes how we collect, use, and store data.
By using the App, you consent to the processing of your data in accordance with that policy.

6. Intellectual Property

All materials in the App — including but not limited to software, design, graphics, text, and AI models — are owned or licensed by VAR TIM SOFTWARE SRL and are protected by copyright, trademark, and other applicable laws.
You may not reproduce, distribute, or create derivative works without prior written consent.

7. Acceptable Use

You agree to use Popshot only for lawful purposes. You must not:

Upload content that is illegal, harmful, defamatory, or infringing on others’ rights;
Attempt to generate or edit content involving nudity, violence, or hate speech;
Use the App to train or benchmark other AI systems.

We reserve the right to suspend or terminate access if misuse is detected.

8. Service Availability and Modifications

Popshot is provided “as is” and “as available”.
We may update, modify, or discontinue parts of the App at any time without prior notice.
We do not guarantee uninterrupted or error-free operation.

9. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

Fitness for a particular purpose,
Non-infringement, and
Availability or reliability of the App.

Your use of Popshot is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, VAR TIM SOFTWARE SRL, its directors, employees, and partners shall not be liable for:

Any indirect, incidental, or consequential damages,
Loss of data, revenue, or profits,
Any damage arising from your use or inability to use Popshot.

Our total liability shall not exceed the amount paid by you (if any) for your subscription in the 12 months preceding the event giving rise to the claim.

11. Termination

We may suspend or terminate your access to Popshot at any time if you violate these Terms or use the App in a way that could cause harm.
Upon termination, all rights granted to you under these Terms will immediately cease.

12. Governing Law

These Terms are governed by the laws of Romania, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms shall be resolved exclusively in the courts of Timisoara, Romania.

13. Changes to These Terms

We may revise these Terms periodically.
The latest version will always be available within the App or on our website.
Continued use after updates constitutes your acceptance of the revised Terms.
